Terms of Service

These terms govern your use of CheekyBell (the "App", "Service"), provided by CheekyBell ("we", "us", "our"). By creating an account or using the Service in solo mode, you agree to these terms. If you do not agree, do not use the Service.

1. Eligibility

You must be 18 years of age or older to use CheekyBell. By using the Service, you confirm that you meet this requirement and that your use of the Service complies with applicable laws in your jurisdiction.

2. Your account

  • Provide accurate information when creating an account. Choose a strong password (at least 12 characters).
  • You are responsible for activity under your account. Notify us at support@cheekybell.com immediately if you suspect unauthorized access.
  • You may delete your account at any time from Settings → Privacy → Delete Account. Deletion is permanent.

3. Acceptable use

CheekyBell is intended for consenting adult couples to communicate intimately. You agree not to:

  • Use the Service to harass, threaten, defame, or stalk another person.
  • Send content depicting minors in any sexual context. Such content is illegal and we will report it to authorities.
  • Send non-consensual intimate imagery ("revenge porn"), spam, malware, or unlawful content.
  • Attempt to bypass rate limits, scrape data, reverse-engineer the Service, or interfere with its security.
  • Impersonate others or misrepresent your affiliation with any person or entity.
  • Use the Service to violate any applicable law or regulation.

We may suspend or terminate accounts that violate these rules without prior notice when necessary to protect users or comply with the law.

Use the message or AI response safety menu to report content, block a user, stop an interaction, or contact support. We aim to review urgent safety reports within 4 hours and other reports within 24 hours. If anyone is in immediate danger, contact local emergency services; CheekyBell is not an emergency service.

4. Your content

You retain ownership of content you create or upload (chat messages, bell customization, fertility data, photos). By using the Service, you grant us a limited, non-exclusive licence to store, process, and transmit your content solely as needed to operate the features you use. We do not use your intimate content to train ML models or for advertising.

You are responsible for the legality of content you submit. You represent that you have all rights necessary to upload and share it.

Reports store a content reference and your selected reason, not a second copy of the reported private content. We may restrict or remove referenced content after review.

5. Solo mode and partner pairing

  • Solo mode is free and works without an account. Local data may sync to your account when you sign up.
  • Partner pairing requires mutual consent. Either partner may unpair at any time; pairing data is preserved with an "ended" status until manually deleted.

6. Subscriptions and in-app purchases

  • Premium and bell-customization purchases are billed by Apple (App Store) or Google (Play Store) per their respective terms.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Manage or cancel from your Apple ID / Google Play account settings.
  • Refunds are governed by Apple/Google policies. We do not directly process refunds for store-billed purchases.
  • Premium entitlements are tied to your account. Sharing entitlements with a partnership is provided as a feature where eligible; revocation rules apply when partnerships end.

7. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, push updates, or restrict features as needed for security, performance, or compliance.

8. Privacy

Our handling of your personal data is described in the Privacy Policy, which is incorporated into these terms by reference.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these terms, abuse the Service, or if required by law. On termination, your data is removed in line with the retention table in the Privacy Policy.

10. Disclaimers

The Service is provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted.

The fertility tracking, AI companion, and similar features are informational only. They are not medical advice. Consult a qualified professional for medical, legal, or psychological matters.

11. Limitation of liability

To the maximum extent permitted by law, CheekyBell shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our aggregate liability for any claim is limited to the amount you paid us in the twelve (12) months preceding the claim, or USD 50, whichever is greater.

Some jurisdictions do not allow these limitations; in those cases, our liability is limited to the smallest extent permitted by law.

12. Changes to these terms

We may update these terms from time to time. Material changes will be announced in-app and by email at least 14 days before they take effect. Continued use after the effective date means you accept the updated terms.

13. Governing law and disputes

These terms are governed by the laws of Hungary, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Budapest, Hungary, unless mandatory consumer-protection laws in your jurisdiction provide otherwise.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform.
